Platform status, liability limits, and user risks disclaimer

This document explains the legal status of the LetFlat.net platform, the limits of the platform’s liability and the basic risks users should take into account when using the service.

This document applies together with:

  • the Terms of Use,
  • the Listing Publication and Moderation Rules,
  • the Paid Services Terms,
  • the Privacy Policy,
  • the other platform documents.

1. Platform status

1.1. LetFlat.net is an online platform providing the technical ability to:

  • publish long-term residential rental listings;
  • view listings;
  • use additional platform functions;
  • contact users who posted listings directly through the contact details they provided.

1.2. Unless expressly stated otherwise, LetFlat.net is not a real estate agency, is not a party to the rental agreement, does not represent the landlord or the tenant, does not manage properties, does not guarantee a transaction and does not charge a commission on rent or on transactions between users.

1.3. The platform provides infrastructure and tools but does not replace legal, real estate, financial, tax, immigration or other professional assistance.

2. What the platform does and does not do

2.1. What the platform does

LetFlat.net may:

  • store and display listings;
  • moderate listings and advertising materials;
  • provide listing promotion functions;
  • display advertising;
  • provide technical document-related services;
  • allow users to contact one another directly.

2.2. What the platform does not do

LetFlat.net does not undertake to:

  • verify the legal status of the property;
  • verify the user’s right to rent out the property;
  • verify the lawfulness of subletting;
  • verify the identity of a user other than basic e-mail verification;
  • verify the good faith, solvency or reliability of the parties;
  • confirm the actual existence of the property in all cases;
  • verify compliance of the property with the requirements of a specific country, city, contract or user situation;
  • participate in negotiations between users;
  • ensure conclusion of a transaction;
  • ensure performance of a transaction.

3. Listings are published by users under their own responsibility

3.1. All listings on the platform are published by users.

3.2. The user who publishes a listing remains solely responsible for:

  • the content of the listing;
  • the accuracy of the data;
  • the correctness of the price;
  • the lawfulness of publication;
  • the lawfulness of offering the property for rent;
  • having rights to photos, text and other materials;
  • compliance with the law and third-party rights.

3.3. Even if a listing has passed moderation, this does not mean that the platform:

  • confirms its accuracy;
  • confirms the right to rent out the property;
  • confirms the lawfulness of subletting;
  • confirms the safety of the transaction;
  • guarantees the absence of risks for another user.

4. Risks assumed by the user

By using the platform, the user understands and accepts that the following risks may exist in particular:

  • 4.1. The risk of inaccurate information in a listing;
  • 4.2. The risk of dealing with a dishonest user;
  • 4.3. The risk that the property does not match expectations or the description;
  • 4.4. The risk that the publishing user does not have sufficient rights to rent out the property;
  • 4.5. The risk that subletting may be unlawful;
  • 4.6. The risk that a transaction between users does not take place or is disrupted;
  • 4.7. The risk that third parties will not accept documents, dossiers or other materials prepared using the platform;
  • 4.8. The risk of technical failures, temporary unavailability of certain functions, loss of time or the need to re-enter data.

5. Direct communication between users

5.1. On the platform, users may contact one another directly through the contact details indicated in a listing, including e-mail and/or WhatsApp.

5.2. Once such direct communication begins, LetFlat.net does not control:

  • the content of the correspondence;
  • the parties’ promises;
  • the parties’ arrangements;
  • the transfer of documents;
  • meeting arrangements;
  • payment arrangements;
  • the conclusion or performance of contracts.

5.3. The user alone decides whether to contact the other party, transmit documents, trust the information, visit the property or take any action regarding the transaction.

6. The platform does not guarantee any result

6.1. LetFlat.net does not guarantee:

  • successful rental of an apartment;
  • successful search for accommodation;
  • receiving responses;
  • finding a tenant;
  • obtaining favourable terms;
  • acceptance of a dossier by third parties;
  • commercial results from promotion or advertising;
  • achievement of any economic, legal or practical objective pursued by the user.

6.2. The absence of the desired result does not mean that the platform has breached its obligations.

7. Document-related services: special warning

7.1. Document scanning and dossier assembly services on LetFlat are technical tools, not professional advice.

7.2. LetFlat.net does not guarantee that:

  • a document will be correctly recognised;
  • the dossier will be complete;
  • the dossier will be accepted by a landlord, agency, employer, institution or any third party;
  • the result will be legally sufficient;
  • the result will be suitable for a specific procedure or the user’s individual situation.

7.3. The user alone decides which data to enter, which documents to upload, which files to include in the dossier and how and to whom to use the result.

7.4. The user remains solely responsible for the lawfulness, appropriateness and safety of using document-related services.

8. Paid services: special warning

8.1. Paid platform services, including listing promotion, highlighting, advertising and document-related services, are provided as service and technical functions of the platform.

8.2. LetFlat.net does not guarantee the effectiveness of those services.

8.3. The user understands that:

  • promotion does not guarantee responses;
  • highlighting does not guarantee a tenant;
  • advertising does not guarantee sales or leads;
  • dossier assembly does not guarantee acceptance by third parties.

8.4. Once a service has actually been activated or launched, no refund is available to the extent permitted by applicable law and the platform documents.

9. Moderation is not equivalent to a legal check

9.1. Moderation on LetFlat is intended to reduce obvious risks, but it is not a full legal or factual review.

9.2. Moderation does not mean that the platform has:

  • verified ownership rights;
  • checked contracts;
  • verified consent to subletting;
  • verified the identity of the publishing user other than e-mail verification;
  • verified the lawfulness of all user actions;
  • checked all documents relating to the property.

9.3. A user should not rely solely on the fact that a listing is published on the platform as proof of its lawfulness or accuracy.

10. No responsibility for transactions between users

10.1. Any negotiations, arrangements, transfer of documents, meetings, payments, disputes and contracts between users take place outside LetFlat.net’s responsibility.

10.2. LetFlat.net is not responsible for:

  • withdrawal from a transaction;
  • failure of a transaction;
  • user losses;
  • dishonest conduct by the other party;
  • transfer of incorrect documents;
  • misleading conduct by another user;
  • any consequences of performing or failing to perform private arrangements between users.

11. Technical availability of the platform

11.1. LetFlat.net aims to maintain the operability of the platform but does not guarantee:

  • permanent availability 24/7;
  • absence of interruptions;
  • absence of errors;
  • compatibility with all devices and browsers;
  • absence of delays, freezes or failures;
  • permanent immutability of the functionality.

11.2. The platform may:

  • update the service;
  • change the interface;
  • disable functions;
  • introduce new restrictions;
  • temporarily suspend parts of the service;
  • terminate certain functions.

12. Moderation, removal and blocking

12.1. LetFlat.net may, at its discretion and within the law:

  • reject listings;
  • hide listings;
  • delete listings;
  • restrict advertising;
  • restrict account functions;
  • temporarily or permanently block a user.

12.2. The existence of that right does not mean that the platform must always give prior warning, especially where the breach is manifest or creates a risk for users, the platform or third parties.

13. The user must exercise their own caution

Users are encouraged to verify for themselves in a reasonable manner:

  • the identity of the other party;
  • the right to rent out the property;
  • the legal status of subletting;
  • the actual existence of the property;
  • whether the property matches the description;
  • the terms of the contract;
  • the documents they transfer;
  • the risks of communication and the transaction.

No platform function replaces such independent verification.

14. Limitation of platform liability

14.1. To the maximum extent permitted by law, LetFlat.net is not liable for:

  • acts and omissions of users;
  • the content of listings;
  • moderation outcomes;
  • transactions between users;
  • losses caused by relying on another user’s information;
  • technical failures;
  • failure to obtain the desired result from using the platform;
  • indirect losses, loss of profit, loss of opportunities or reputational damage suffered by the user.

14.2. Nothing in this document excludes or limits the platform’s liability where such liability cannot be excluded by law.

15. Applicable law and consumer protection

15.1. This document must be interpreted in accordance with applicable law.

15.2. If the user is a consumer, no provision of this document deprives them of the protection afforded by the mandatory rules applicable to their situation.
